Forced marriage

What forced marriage is

Forced marriage is where one or both people do not give full and free consent to the marriage. The consent cannot be “free” because “force” is a factor.

Force can be:

  • physical abuse or threats
  • verbal abuse or threats
  • emotional abuse or threats
  • taking advantage of someone not being able to consent
  • taking advantage of someone not understanding

People under 16, and some adults with additional needs, cannot give consent.

Forcing someone to marry is a crime in Scotland.

Forced marriage is not the same as arranged marriage

In an arranged marriage, families help choose a partner. However, the marriage has the consent of both parties.

Forced Marriage Protection Order (FMPO)

Courts in Scotland can give a Forced Marriage Protection Order (FMPO). An FMPO can protect adults and children who are in a forced marriage or are being forced to marry.

Ask for a Forced Marriage Protection Order

You can ask for a Forced Marriage Protection Order if you are:

  • in a forced marriage
  • being forced to marry
  • are a relevant third party
  • told you can apply by the Scottish Court
